Nursing Home Malpractice

Nursing home malpractice is any intentional act, or negligence committed by a nursing home professional that has the potential to cause physical, mental, or psychosocial harm to nursing home residents.

Nursing home malpractice can also be financial in nature, if nursing professionals cause injury and loss to patients with respect to their monetary affairs. Inadequate staffing, inexperienced or under-trained staff, and negligent supervision, and patient isolation are also considered instances of nursing home malpractice.

Reporting elder abuse in a managed care facility can also save countless others from suffering the same mistreatment. In many cases, victims are incapable of reporting elder abuse due to dementia, memory loss, social isolation, or humiliation, not to mention fear of reprisals.

The Aged Care Act puts all approved providers under a statutory requirement to provide care and services in accordance with the Quality of Care Principles. They must also maintain an adequate number of appropriately skilled staff to ensure that the residents' care needs are met.
